PainterLab Terms of Service

These Terms of Service (the "Terms") govern your download, installation, and use of the PainterLab mobile application (the "App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

PainterLab is a mobile tool for painting reference, color observation, and study records. The App provides:

  • photo selection and camera capture;
  • on-device value, color, temperature, region, and simplification analysis;
  • local study records;
  • local paint palettes, paint recipes, and color sampling; and
  • PainterLab Pro features purchased through Apple's App Store or Google Play.

PainterLab does not require a user account and does not provide social networking, cloud synchronization, online storage, or an online user account service.

2. Permissions and responsible use

You may use the App only for lawful purposes. You are responsible for:

  • having the necessary rights or permission to import, capture, store, and process photos and other content;
  • complying with applicable law, platform rules, and the privacy, publicity, and intellectual-property rights of others;
  • not using the App to process content that you are not authorized to possess or use; and
  • not interfering with, attacking, exploiting, reverse engineering, cracking, or bypassing the App or its technical safeguards.

Camera and photo permissions are optional. If you deny a permission, the related photo or camera features will not be available.

3. Your content and our intellectual property

You retain your rights in photos, study content, and palette data that you import, capture, or create. The current App processes this content on your device and does not obtain ownership of your photos because you use the App.

PainterLab, its name, trademarks, interface, code, algorithms, visual design, built-in paint data, icons, and other App materials are owned by or licensed to WaveCave and are protected by applicable intellectual-property laws. You may use these materials only as part of your ordinary use of the App. Open-source components remain subject to their applicable licenses.

4. PainterLab Pro purchases and subscriptions

4.1 Purchase platform

PainterLab Pro is offered through Apple's App Store and Google Play's in-app purchase systems. The App currently provides monthly and yearly products. Product names, prices, currencies, taxes, availability, trial eligibility, and purchase terms are determined and displayed by the applicable app store.

4.2 Renewals and trials

If a plan is presented by Apple or Google as an auto-renewable subscription, it renews for the displayed period until you cancel it through the applicable platform. The App currently displays a three-day trial for the yearly plan. Trial eligibility and the price that applies after a trial are determined by the applicable app store and your store account.

If you do not cancel before the end of a trial or billing period, the platform may charge the displayed price for the next period. You can manage or cancel a subscription through your Apple or Google subscription settings.

4.3 Payments, refunds, and restoration

Apple and Google handle payment processing, store accounts, orders, refunds, and purchase records. The App does not directly process payment-card details, payment passwords, or billing addresses. Refunds, billing disputes, and store-account issues must generally be handled through the applicable app store.

You can use the App's restore-purchases feature or the same platform store account to restore an eligible purchase. Because PainterLab does not use user accounts or a WaveCave cloud entitlement system, restoration may depend on the platform account, device, region, and store status.

5. Nature of color analysis

PainterLab is a creative and educational reference tool. Images are affected by camera sensors, displays, lighting, white balance, reflections, compression, and camera position. Value, temperature, color-difference, paint-recipe, and color-comparison results may therefore be inaccurate or incomplete.

The App does not provide instrument-grade color measurement, laboratory measurement, medical advice, engineering advice, commercial quality certification, or other professional advice. Use your own judgment based on the actual materials and lighting conditions.

6. Availability and updates

We may modify, suspend, or discontinue features because of maintenance, platform restrictions, compatibility, security, or other reasons. We do not guarantee that the App will always be available, uninterrupted, error-free, accurate, or compatible with every device.

We may release updates, fix issues, adjust features, or change PainterLab Pro benefits. An update may require a newer operating-system or app version.

7. Third-party platforms and components

The App uses Flutter, camera and photo-selection components, and Apple's App Store and Google Play purchase components. Third-party platforms and components are subject to their own terms, privacy policies, and system rules. WaveCave does not control their availability, processing, policies, or interruptions.

8. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available." We do not guarantee that the App or its analysis results will be completely accurate, continuously available, error-free, fit for a particular purpose, or protected from local data loss.

You are responsible for backing up important photos and study records. Deleting the App, clearing App data, device failure, system cleanup, insufficient storage, or backup failure may result in the loss of local content.

9. Limitation of liability

To the fullest extent permitted by law, WaveCave and its owners, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, punitive, or consequential losses arising from or related to your use of, or inability to use, the App, including loss of profits, revenue, business, data, goodwill, or anticipated savings.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law prohibits that limitation.

10. Changes to these Terms

We may update these Terms when the App, platform rules, or applicable law changes. The updated version will be published on this page with a revised last-updated date. Your continued use of the App after an update takes effect constitutes acceptance of the updated Terms to the extent permitted by law.

11. Governing law and disputes

These Terms are governed by applicable law, without limiting any mandatory consumer protections that apply where you live. Disputes arising from or relating to the App or these Terms will be handled by a court or other forum with jurisdiction under applicable law.
